Under the "Significant Impact Test" a Decision Is a "Land Use Decision" If it Will Have a Significant Impact on Present or Future Land Uses in the Area.
Need Land Use Help In Josephine County? In Oregon there are two tests for determining whether a decision is a "land use decision." One test is based on the law (ORS 197.015(10) and ORS 197.015(12)). The other test is based on appellate court rulings, and is called the "significant impact" test. This self help brochure identifies some resources for neighbors who want to learn more about land use or want to represent themselves in front of local government, or perhaps the Oregon Land Use Board of Appeals.1 Self-help information is neither a recommendation nor legal advice.
